1. Acceptance of Terms
By accessing or using the Quizly platform, including our website, web application, and any related services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the platform. We reserve the right to update these terms at any time, and continued use of Quizly after changes are posted constitutes acceptance of the revised terms.
2. Account Registration
To use Quizly, you must create an account with a valid email address. You agree to:
- Provide accurate and complete registration information.
- Maintain the security of your account credentials.
- Notify us immediately of any unauthorized access to your account.
- Accept responsibility for all activity that occurs under your account.
You must be at least 16 years old to create an account. If you are under 18, you represent that you have parental or guardian consent.
3. Quiz Owner Responsibilities
As a quiz owner (creator), you are responsible for:
- Ensuring all quiz content, questions, and study materials you upload do not infringe on third-party intellectual property rights.
- Clearly communicating exam rules, time limits, and proctoring requirements to test takers before they begin.
- Handling proctoring recordings responsibly and in compliance with applicable privacy laws in your jurisdiction.
- Setting appropriate access controls and sharing permissions for your quizzes.
- Not using the platform to discriminate, harass, or unfairly penalize test takers.
4. Test Taker Responsibilities
As a test taker, you agree to:
- Complete quizzes honestly and without unauthorized assistance.
- Not share quiz questions, answers, or content with others unless explicitly permitted by the quiz owner.
- Not attempt to circumvent proctoring controls, including using virtual cameras, screen-sharing workarounds, or browser extensions designed to bypass monitoring.
- Respect time limits and submission deadlines set by quiz owners.
- Not create multiple accounts to retake quizzes you have been restricted from.
5. Proctoring Consent
Some quizzes on Quizly use proctoring features to maintain exam integrity. By participating in a proctored quiz, you consent to the following:
- Your webcam will be activated to record video during the exam session.
- Your screen activity and browser tab switches may be monitored and logged.
- Recordings and activity logs will be stored securely and shared with the quiz owner for review.
- You will be clearly notified before proctoring begins and must grant explicit permission to proceed.
- Proctoring recordings are retained for up to 90 days unless a shorter period is configured by the quiz owner.
If you do not consent to proctoring, you may choose not to take the proctored quiz. Refusal to enable proctoring will prevent you from starting the exam.
6. Subscription & Billing
- Quizly offers free and paid subscription plans. Paid plans are billed on a monthly or annual basis depending on your selection.
- Payments are processed through secure third-party payment providers. By subscribing, you authorize recurring charges to your payment method.
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period, and no prorated refunds are issued.
- We reserve the right to change pricing with 30 days notice. Existing subscribers will be notified via email before any price changes apply to their accounts.
- If payment fails, we may suspend access to paid features until the balance is resolved.
7. Certificates
Quizly allows quiz owners to issue digital certificates to test takers upon quiz completion. Regarding certificates:
- Certificates are generated based on criteria set by the quiz owner (e.g., minimum passing score).
- Quizly provides certificate verification links but does not guarantee that third-party organizations will accept or recognize these certificates.
- Quiz owners are responsible for the accuracy of the information displayed on certificates they issue.
- Quizly is not an accredited educational institution and certificates issued through the platform should not be misrepresented as accredited credentials.
8. Intellectual Property
- The Quizly platform, including its design, code, branding, and documentation, is the intellectual property of Quizly and is protected by copyright and trademark laws.
- Quiz owners retain ownership of the content they create and upload. By using Quizly, you grant us a limited license to host, display, and distribute your content solely for the purpose of operating the platform.
- Test taker responses are owned by the test taker but may be accessed by the quiz owner for grading and review purposes.
- You may not copy, modify, or reverse-engineer any part of the Quizly platform without written permission.
9. Prohibited Use
You agree not to use Quizly to:
- Upload or distribute malicious content, malware, or phishing material.
- Harass, threaten, or discriminate against other users.
- Attempt to gain unauthorized access to other users' accounts, quiz data, or proctoring recordings.
- Use automated bots or scripts to create accounts, take quizzes, or scrape content.
- Distribute or sell quiz content without the owner's permission.
- Misrepresent your identity or impersonate another person during an exam.
- Interfere with or disrupt the platform's infrastructure or other users' access.
10. Termination
We may suspend or terminate your account if you violate these Terms of Service. You may also delete your account at any time. Upon termination:
- Your access to the platform and all associated features will be revoked.
- Quiz content you created may be retained for a reasonable period to fulfill obligations to test takers who have pending results or certificates.
- Proctoring recordings will be deleted according to our data retention policy.
- Any outstanding subscription fees owed at the time of termination remain payable.
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- Quizly is provided "as is" and "as available" without warranties of any kind, express or implied.
- We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the platform.
- We are not responsible for the accuracy of quiz content created by users or for decisions made based on quiz results or certificates.
- Our total liability to you for any claim arising from these terms shall not exceed the amount you paid to Quizly in the 12 months preceding the claim.
- We are not liable for any loss of data due to circumstances beyond our reasonable control, including but not limited to hardware failures, natural disasters, or cyberattacks.
